Imagine Sarah, a young woman, making her way to her favorite coffee shop. As she strolls along the cobblestone pathway, her foot suddenly catches on a loose paving stone, causing her to slip and fall awkwardly.

With a sharp pain shooting through her ankle, Sarah struggles to regain her balance, realizing she has twisted and injured her ankle in the fall. Despite the picturesque surroundings, Sarah’s morning takes an unexpected turn as she grapples with the aftermath of her unexpected slip-and-fall accident.

Slip-and-fall accidents are unfortunately very common, with thousands occurring every day. These accidents can lead to a variety of injuries, from minor bruises and scrapes to more severe injuries like broken bones, traumatic brain injuries, and even death in extreme cases.

One of the most common injuries in slip-and-fall accidents is a sprained ankle. While not usually as severe as other ankle injuries, sprained ankles can still be very painful and disruptive to one’s daily life.

If you have suffered a sprained ankle from a slip-and-fall that was caused by another party’s negligence, you may be entitled to compensation through a settlement.

In this article, we’ll look at how slip-and-fall cases work, how to calculate a settlement for a sprained ankle and other ankle injuries, and how an experienced personal injury lawyer can help maximize your compensation.

How Slip-and-Fall Accident Cases Work

To receive compensation after a slip-and-fall accident, you must prove that another party was negligent and responsible for your injuries. Most often, slip-and-fall cases involve accidents that occur on someone else’s property, like a store, restaurant, apartment complex, etc. The property owner has a responsibility to keep their premises reasonably safe for visitors. If they fail to do so, they can be held liable through premises liability laws.

To build a strong slip-and-fall case, you must prove:

The property owner created or knew about the hazardous condition that caused your fall

They failed to properly repair the hazard or warn visitors about it

Their negligence directly led to your fall and subsequent injuries

Examples of dangerous conditions that could lead to a premises liability slip-and-fall case include:

Wet or slippery floors

Uneven pavement or steps

Poor lighting

Cluttered walkways

Lack of handrails on stairs

If you sprained your ankle in a slip-and-fall accident due to any dangerous conditions that the property owner failed to address, you may have a case.

An experienced personal injury lawyer can help investigate your accident, gather evidence, and build a compelling argument to prove negligence.

Factors That Determine Your Injury Settlement

If you are successful in proving negligence in your slip-and-fall case, you will then need to calculate damages to determine a settlement amount that covers your losses.

Some factors that influence settlement amounts include:

Severity of the injury: More severe sprains that require surgery or extensive medical treatment will increase the average settlement value.

Need for ongoing medical treatment: If you require physical therapy, follow-up doctor visits, or continuing medication, your settlement may be higher.

Lost income: Any wages you lost due to missing work during your recovery are included in a settlement.

Medical expenses: All costs associated with diagnosing and treating your ankle injuries are factored in.

Pain and suffering: You can receive additional compensation for physical pain and emotional distress.

Out-of-pocket costs: Medications, medical equipment, transportation to appointments, etc.

Loss of enjoyment: Compensation for impact to your quality of life and ability to participate in activities.

At-fault party’s insurance coverage: There may be limits on what insurance will pay out.

Your specific circumstances and losses will determine the total settlement value. More serious injuries with high costs and losses typically result in larger settlements, while less severe cases have lower settlements.

Average Settlement Amounts for Ankle Injuries

It’s difficult to pinpoint an exact average settlement for ankle injuries from a slip-and-fall, as each case has unique factors. However, most minor injury cases settle for between $10,000 and $30,000. Moderate sprains requiring some surgery may receive $30,000 to $75,000. Significant injuries sustained requiring extensive medical treatment could receive well over $100,000 in some personal injury cases.

Talk to your ankle injury attorney about what settlement range you can realistically expect based on the details of your accident and losses.

Don’t accept an early lowball offer from an insurance company before you know the full value of your claim.

Why You Need an Experienced Slip-and-Fall Injury Lawyer

Ankle injuries might seem like relatively minor injuries, but even they can have complications and long-lasting effects if not properly treated. Dealing directly with insurance companies can be difficult, as they will seek to minimize costs and may try to deny or reduce your claim. Having a knowledgeable slip-and-fall injury lawyer on your side levels the playing field.

A slip-and-fall injury lawyer will handle all aspects of your slip-and-fall case while you focus on recovery. They will conduct a thorough investigation, identify all liable parties, gather supporting evidence, calculate damages, negotiate aggressively on your behalf, and take the slip-and-fall lawsuit to court if needed.

Their experience with slip-and-fall cases gives them strategic negotiation skills to maximize your settlement. With strong legal representation, you are more likely to recover full and fair compensation without the stress of handling it all yourself.

Don’t leave money on the table or let insurance companies take advantage of you. Contact a reputable slip-and-fall injury law firm as soon as possible after your slip-and-fall accident to protect your right to compensation. They can provide personalized guidance for getting the maximum settlement you deserve.

The Dangers of Slip-and-Fall Accidents

According to the National Safety Council (NSC), over 37 million fall injuries occur in the US each year. Slip-and-fall accidents are one of the most common causes of these fall injuries. The combination of slippery surfaces, uneven ground, poor lighting, and cluttered areas frequently lead to a slip-and-fall incident in homes, businesses, and public spaces.

While some minor injuries may result, slip-and-fall accidents can also cause severe injuries.

Some potential injuries include:

Sprains and strains: Ankles and wrists are particularly susceptible.

Bone fractures: Broken hips, wrists, legs, arms, and ankles are common.

Traumatic brain injury: Head trauma from the impact can cause concussions or worse.

Spinal cord injuries: Damage to the neck and back can lead to paralysis.

Death: In extreme cases, falls can be fatal due to head trauma or organ damage.

In addition to physical harm, slip-and-fall accident victims are often left with exorbitant medical bills, lost income, pain and suffering, and reduced mobility. Holding a negligent property owner accountable is crucial.

How Fault Is Determined in Slip-and-Fall Accident Cases

To receive compensation for your slip-and-fall injuries and damages, you must prove that your accident occurred due to another party’s negligence and failure to provide safe premises. This falls under premises liability law.

The general criteria for proving fault in slip-and-fall claims include:

Dangerous condition: There must be proof of an unsafe condition like a wet floor, poor lighting, defective stairs, etc.

Notice: It must be shown that the property owner knew or reasonably should have known about the hazardous condition but failed to take corrective action. This is often the most contested part of slip-and-fall cases.

Causation: Evidence must demonstrate that the hazardous condition directly caused the victim’s fall and subsequent injuries.

Damages: Medical bills, lost wages, pain and suffering resulting from the victim’s injuries must be calculable and provable.

Liability limits: If slip-and-fall accidents occur on a commercial property, the owner’s insurance liability limits can come into play.

Securing the evidence necessary to prove each of these criteria requires experience. A seasoned slip-and-fall attorney knows how to thoroughly investigate an accident scene, obtain witness statements, prove notice standards were not met, and demonstrate how your injuries relate to the slip-and-fall incident. Having a skilled lawyer in your corner levels the playing field against big insurance companies.

Why Prompt Medical Care Is Crucial After a Fall

It’s understandable to feel shaken up and disoriented after suffering a slip-and-fall. However, it is vital that you seek medical treatment following any kind of fall accident, even if you don’t think you sustained serious injuries.

Here’s why:

Adrenaline can mask debilitating injuries like fractures of the ankle bones, traumatic brain injury, organ damage, soft tissue injuries, or internal bleeding. Seeing a doctor quickly can catch other injuries before they worsen.

Medical documentation from the earliest care establishes a record of injuries that insurance companies can’t dispute later in your personal injury case.

Delaying medical treatment gives insurance companies reason to doubt accident-relatedness of late-arising symptoms.

Quick care demonstrates you were proactive about mitigating damages and preventing catastrophic injury.

Waiting to get checked out can negatively impact your recovery outlook.

After your initial emergency room visit or urgent care check, follow all doctor recommendations for medications, diagnostic tests, specialists, physical therapy, and follow-ups. Non-compliance with your medical care recommendations will also jeopardize your ankle injury claim and your ability to seek compensation down the road.

Watch Out for Insurance Company Tactics

Insurance companies aren’t necessarily malicious, but they are for-profit businesses. Their primary obligation is to their shareholders, not to accident victims.

They will use tactics to pay as little on personal injury claims as possible.

Some things to watch out for include:

Quick settlement offers: They want to settle before full damages are calculable.

Lowball offers: They make unreasonably low opening offers hoping you’ll accept.

Denials: They might deny a slip-and-fall claim due to pre-existing conditions, lack of maintenance records, or other technicalities.

Delays: Drawing the process out tires claimants.

Surveillance: Insurance investigators may covertly watch to see if you exaggerate injuries.

Having experienced slip-and-fall attorneys on your side prepares you for delays, denials, and other insurance company antics. Your lawyers will tenaciously negotiate to get you the maximum recovery possible.

The Challenges of Proving Constructive Notice

As mentioned, a critical component is proving a property owner’s negligence. By showing that the property owner had reasonable “notice” of the dangerous condition that caused the fall, you can pursue maximum compensation.

This notice can be either actual or constructive. Actual notice means they directly created the hazard or observed it themselves. Proving actual notice is relatively straightforward with eyewitnesses or recordings, for example.

Constructive notice is more difficult to establish. This refers to reasonable proof that the hazard existed long enough that the owner should have discovered and remedied it. The longer the hazard existed, the greater the likelihood that the owner had constructive notice of it.

Some factors in proving constructive notice include:

High-traffic area: Hazards in busy zones should be spotted sooner.

Previous incidents: Other falls in the same area signal an ongoing issue.

Poor maintenance: Insufficient inspection and upkeep make hazards likely.

Obvious hazard: Large spills should not go unnoticed for long.

Even with these considerations, proving constructive notice often comes down to reasonable timeframes, which are subjective. An experienced slip-and-fall lawyer knows how to build the strongest argument possible to convince adjusters, judges, and juries that notice requirements were breached.

Overcoming Contributory Negligence Defenses

In a small minority of states, any negligence by the victim in causing their own accident can bar them from compensation. However, most states like Indiana follow modified comparative negligence rules. Under this model, you can still recover damages if you are no more than 50% at fault. Above 50%, and your slip-and-fall claim is barred.

How much you can recover also depends on your percentage of fault. If found 25% negligent, your final slip-and-fall settlement would be reduced by 25%, for example. Property owners will look for any minor carelessness on your part to reduce liability.

Some contributory negligence arguments they may make include:

You weren’t paying attention to your surroundings.

You knew about the hazard but proceeded anyway.

You continued using an area despite warning signs.

You were wearing improper footwear for conditions.

You were under the influence of drugs or alcohol.

Skilled personal injury attorneys expect these arguments. They thoroughly investigate slip-and-fall accident scenes and aggressively refute unreasonable allegations of comparative negligence made by insurance companies during slip-and-fall lawsuits.

Don’t let bogus defenses cost you the compensation you deserve.

Establishing Damages in Your Slip-and-Fall Accident Claim

Assuming liability is proven, the next step is calculating damages - the monetary costs of the victim’s injuries and losses.

Economic damages personal injury lawyers may seek compensation for after a severe injury in a personal injury claim include:

Past and future medical expenses and care

Rehabilitation and physical therapy for sustained injuries

Medical equipment and modifications

Lost wages from missed work time

Reduced earning capacity

Pain and suffering

Emotional distress

Loss of enjoyment and activities

Permanent disability or disfigurement

Quantifying these damages requires pulling together sufficient evidence and documentation. Your lawyer will gather medical bills and records, employment records, receipts and bills, and other proof to justify the compensation being sought in negotiations or court.

Seeking Maximum Settlements in Slip-and-Fall Death Cases

In the most severe cases, slip-and-fall accidents result in fatalities. When an accident leads to a wrongful death due to negligence, the financial consequences for the victim’s family can be devastating.

Some damages the family may claim include:

Medical bills and funeral expenses

Loss of current and future income

Loss of benefits like health insurance

Loss of household services the victim provided

Loss of companionship and guidance

Pain and suffering of family members

Money can never replace a lost loved one. However, holding negligent parties fully accountable can provide some financial stability for grieving families. Experienced personal injury lawyers aggressively pursue maximum settlements and verdicts in fatal slip-and-fall cases.

Whether there are blizzards or rain has turned to freezing rain, winter is a dangerous time of year. One of the more common ways to injure yourself in winter is to have a slip and fall accident on ice, especially in typically smooth areas such as parking lots or sidewalks. But you may be wondering, Can you sue for slipping on ice in a parking lot?

While these injuries are often minor, slip and fall accidents on snow and ice can be serious. Understanding your legal rights after a slip is essential, as it can mean recovering compensation for your pain and suffering. Read on to learn more about your rights, and how to bring legal action, after a slip in a parking lot.

What Caused the Fall?

While some parking lot slips are purely accidental, such as an untied shoelace or something similar, some falls are caused by hazardous conditions. Hazardous conditions refer to any condition in a parking lot that is out of the norm or may cause someone to have an accident. In a store, this could be uneven flooring. In a parking lot, this can refer to potholes, wet paint, or even uncleared snow and ice.

If your fall was caused by a hazardous condition, then it’s important to document what the exact cause was. This could be ice, snow, or water from melted snow/ice. You should take note of where it is located, and, if you are able, take a photo with your phone of the area where the slip occurred.

What Is the Obligation of the Parking Lot Owner?

In Indiana, store owners have a general duty to reasonably clear snow and ice from their property. This includes parking lots. But what does reasonable care of their property entail? In slips, this is generally judged case-by-case and may involve the judge determining if the property owner showed some attempts to keep their property safe.

What Should You Do After a Fall?

What you do next should be determined by how injured you were in the fall. If you believe you broke anything or hit your head, you should call emergency services first. If you don’t need immediate medical attention, you should report the fall to the property owner or a manager.

Tell them exactly where it occurred, so they can clear the area so no one else is injured, and when it occurred. They may ask you to fill out an incident report. Having an incident report can be a helpful document to have for later, but be wary of signing any waivers involved with the report. When in doubt, discuss the report with your personal injury lawyer before filling it out or signing anything.

Additionally, you should document the fall area by taking photos and if there are any witnesses, ask for their contact information in case you need them to testify to the nature of your fall.

After you have done these things, even if you don’t have a noticeable injury, it is wise to visit a doctor. Some injuries may take time to appear or seem less visibly serious than they actually are. A doctor will be able to assess if you have any hidden injuries and the extent of any visible injuries that you have. Remember to ask your doctor to provide a medical report, in case you need documentation of your injuries.

How Can a Personal Injury Attorney Help?

Injuries after falls can be serious and may require medical help, medication, x-rays, time off of work, and other costly elements. You must receive the compensation that you are entitled to in order to cover these costs.

Slip and fall injuries in Indiana can be complicated, and this is even more accurate when the injury is caused by natural weather issues such as snow and ice. A personal injury lawyer can help you document your case, talk to witnesses, help you fill out paperwork, and ensure that your case receives the care and attention it deserves.

All it takes is one dangerous step and you could have a slip that causes severe injury. Some of the most common household causes of slip and fall injuries include ladders, stairs, loose flooring, scattered objects, and uneven surfaces. You may be eligible for compensation if you were injured on HOA property.

Homeowners associations are known for providing beautiful neighborhoods with desirable amenities that enhance a robust community lifestyle.

Unfortunately, not all HOAs are quick to repair property damage or complete routine maintenance on their property and their neglect creates opportunities for injury. When you’re injured on someone’s property. Meanwhile, the bills start rolling in.

Most ER bills are at least $3,000 and the average slip and fall brings $10,000 or more in costs. That’s a large burden to carry alone, especially if someone else might be at fault, which impacts your right to monetary damages.

Who’s Liable for Your Slip and Fall When Injured on HOA Property?

After a slip and fall injury, it’s important to identify who’s responsible for maintaining the area where you were injured. For homeowners who live in communities with homeowners associations (HOAs), this could mean the HOA can be held accountable for maintaining a communal area.

Your HOA is a business organization that has a legally binding duty of care. If the HOA fails to prevent foreseeable harm, there’s a legal process for the injured person. The HOA can be held responsible for harm caused on HOA property.

For example, in a condo community with a homeowners association, the homeowner may be responsible for the area inside their condo and the HOA is responsible for common areas like the parking lot, sidewalks, swimming pools, and landscaping.

If dangerous conditions were present and the Homeowner’s Association failed to fix them, that’s a breach of contract.

The HOA is responsible for addressing a preventable hazard in common areas on association property. Most HOA contracts state clearly what HOA officials are responsible for and when they don’t uphold their end of the contract, it’s a breach of duty.

For example, if you slipped on loose or icy pavement and fell in the parking lot, the HOA might be responsible for paying your medical bills and other damages.

Premises liability means your homeowner’s association is held liable for injuries that occur on their property. Personal injury cases that fall under a premises liability claim don’t have to prove intentional harm. You just have to prove the HOA breached their fiduciary duty to maintain the property.

To hold your HOA accountable and get the maximum compensation from their insurance company, you’ll need an experienced Indiana accident attorney who understands premises liability, homeowners associations, and legal options for your car accident case.

Did The Homeowners Association Protect The Community’s Best Interests?

Reasonable care, within the context of a Homeowners Association (HOA), encompasses the level of caution and consideration for one’s safety and that of others that an ordinarily prudent and rational person would employ in the given circumstances. This standard serves as a subjective measure to determine whether an individual is negligent, based on typical expectations on HOA property. To prove your case you must prove the HOS didn’t exercise reasonable care.

You May Be Able to Sue The HOA for a Breach of Contract

Your first step is to familiarize yourself with your neighborhood’s bylaws, declaration of covenants, conditions, and restrictions (or CC&Rs). These policies are a formal agreement between residents and homeowners, including how they will maintain common areas like sidewalks and the clubhouse.

The HOA must perform its duties in a diligent and good-faith manner.

HOA Must Follow The Rules Outlined in the CC&Rs.

The homeowner’s association’s legal duty is to ensure their property is safe for multiple parties (including adults, children, and pets.) Their goal is to follow legal standards to protect individuals from any unsafe condition that develops on their property.

Let’s say that you tripped over the uneven walkway leading into the community pool and broke your hip. If the HOA is in charge of maintaining that walkway but has put off repairing the uneven pavement, or has mismanaged the funds needed to pay for repairs, then you may be able to sue them for financial compensation.

Another example of negligence could occur when the HOA fails to properly manage its pool chemicals or pool maintenance equipment, and you’re injured by the chemicals, you may have grounds for a premises liability case.

Understanding Premises Liability: How to Hold Your HOA Responsible

Your HOA may try to avoid responsibility for your slip and fall, perhaps pointing to a clause in some paperwork that seems to release them from liability.

Don’t take their word for it. Indiana has strong laws regarding premises liability and you may have a solid case against the HOA.

Falls account for over 8 million hospital emergency room visits, representing the leading cause of visits (21.3%). Slips and falls account for over 1 million visits or 12% of total falls.

Fractures are the most serious consequences of falls and occur in 5% of all people who fall.

Each year in the United States, one of every three persons over the age of 65 will experience a fall. Half of them are repeat fallers.

According to the CDC, in 2005, more than 15,000 people over the age of 65 died as a result of a fall - up from 7,700 a decade earlier.

The CDC also reports that approximately 1.8 million people over the age of 65 were treated in an emergency room as a result of a fall.

As you can see, slip and fall accidents are serious. The question many of our clients have is, “Can you sue for slipping on ice?”

The short answer is yes. You can sue for a fall on ice if your injuries were the result of a property owner’s negligence related to snow and ice removal. In these circumstances, you may have a right to compensation for your injuries and losses. A personal injury attorney can help you file a claim and fight for appropriate compensation.

Why Are Slip and Falls on Ice So Dangerous?

We all know that ice is slippery, but the problem is that ice is slippery and difficult to see. Ice is not always visible, and victims can fall suddenly without realizing that they are at risk of a fall.

Slipping on black ice is always a major hazard.

Snow can be slippery, especially if a layer of ice is underneath and the snow has begun to melt. Partially melted and refrozen ice creates uneven surfaces, leading to falls even when things aren’t as slick.

Because ice often forms on hard, unyielding surfaces, these falls usually result in some kind of injury.

Types of Injuries Caused by Slip and Fall Accidents

A slip on the ice can cause multiple types of injuries, which can range from minor to severe. These include:

Broken bones and fractures

Sprains and strains

Head injuries like concussions

Back and neck injuries

Traumatic brain injuries

Joint injuries

Hip fractures

Internal organ damage

How Can an Attorney Help You After a Slip and Fall on Ice?

If you have been injured in a slip-and-fall accident, it is important to contact a personal injury attorney to determine your legal options. If your fall was the result of someone else’s negligence or carelessness, you may be able to receive compensation for your losses.

An attorney can help you with the following essential steps after an accident:

Collect and review evidence from the scene of the accident

Investigate the accident to understand what contributed to your fall

Identify all liable parties

Negotiate with insurance companies on your behalf

Determine the value of your claim by documenting and calculating your injuries, expenses, lost income, pain and suffering, and more

File court documents

When you have an experienced attorney on your side, you increase your chances of recovering maximum compensation.

Who Is Responsible for a Slip and Fall?

One of the responsibilities of your attorney is to identify the liable party or parties, as their action (or inaction) caused your injuries.

Liability depends on whether the hazardous accumulation of ice was something the property owner or manager should have known about and addressed reasonably. If the responsible party fails to properly maintain the property, identify icy conditions, or address risk factors, then they may be named in a liability claim.

Challenges to Getting Compensation for an Indianapolis Slip and Fall on Ice

An insurance company may try to argue that a fall victim “should have known it was icy” and “should have taken precautions to avoid a fall.”

It can be challenging to establish negligence and liability, which is why it is always better to work with an experienced slip-and-fall attorney who can clearly lay out the case regarding who was responsible.

According to the CDC, more than 800,000 people are hospitalized annually due to fall-related injuries, which is why it’s important to know what to do after a slip and fall accident. Of those sustained injuries, traumatic brain injuries are the most common.

Not only can slip and fall injuries be traumatic and life-threatening, but they can also be costly to treat. On average, the yearly cost for treatment of fall injuries is in the billions. In 2015, it was reported to be $50 billion.

Fortunately, you can seek compensation for the treatment of slip and fall injuries. However, to win your case and recover the compensation you deserve, you must prove that another party was liable for your slip and fall accident. This is why the steps you take after a slip and fall are so important, as they can play a role in your case and the settlement you are awarded.

At Crossen Law Firm, we have years of experience handling slip and fall cases in Indianapolis and the surrounding areas. If you need help proving fault and recovering compensation for your injuries, we can help.

How Do Slip and Fall Accidents Happen?

Slip and fall accidents can happen in any number of situations. However, they are most often a matter of premises liability, meaning they usually occur due to negligent property owners.

Property owners are legally responsible for maintaining a safe premise. This means ensuring their property is free of hazards that could cause someone harm. If a known hazard causes someone to slip and fall and injure themselves, the property owner can then be held liable and financially responsible for the damages suffered, such as the medical expenses to treat the victim’s injury.

Examples of situations and places where slip and fall accidents can occur due to negligent property owners include:

Uneven or slippery surfaces at amusement parks

Spilled liquids or foods in grocery stores

Recently mopped or waxed floors in retail stores

Slippery surfaces in restaurants

Poor lighting or lack of handrails in stairwells

Broken or uneven flooring

Uncleared snow or ice on sidewalks or pathways owned by businesses

Cluttered floors in stores

Loose carpeting or rugs

Loose wires

Slip and Fall Injury Treatment

Again, the annual cost of slip and fall injury treatments is typically billions of dollars. And while health insurance might cover some of those expenses, it certainly doesn’t cover it all. It also depends on whether or not the victim has insurance or what kind of coverage their plan provides.

Of course, some slip and fall accidents might only result in minor injuries, such as scrapes, bumps, and bruises. However, it is common for slip and fall accidents to result in severe injuries, especially if the victim falls on a hard surface or from a great height.

For example, if someone slips and falls on carpeting, they might walk away with a minor bruise. But if someone slips and falls down a flight of stairs or falls on a hard surface and hits their head, the injury will likely be much more severe. And the treatment for those severe injuries will be more extensive and costly.

Traumatic brain injuries, for instance, are common injuries sustained in slip and fall accidents. And depending on how extensive the brain injury is, it could cost thousands of dollars to treat and could even leave the victim permanently impaired or disabled.

In the worst cases, slip and fall accidents can result in death, leaving the family members and loved ones to pay for the medical bills.

What to Do After A Slip and Fall Accident

To ensure you win your slip and fall case, it’s important to take certain measures. Below are the steps to take after a slip and fall accident:

Get medical attention: After a slip and fall, your well-being should be your number one priority. If you are badly injured, seek medical attention as soon as possible. Documents proving you were treated for injuries will also serve as evidence to help you win your case, so make sure you keep copies of all your medical bills and any other documents given to you by the doctor.

Report the accident: Many people often ask how to report a slip and fall when these things happen. Depending on where you are, you will want to find someone in charge and ensure they file an official report of the incident. Do not simply rely on just anyone to report it. Make sure someone in charge is directly notified. If no report is filed, the business or property owner could try to claim that there is no evidence of such an incident ever occurring.

Gather evidence: To back up your claim, make sure you gather evidence at the scene of the accident if you can. This includes taking photos of where you slipped and fell and what caused you to slip and fall. You can also take videos with your phone. Witnesses who saw what happened can also be used as evidence, so make sure you get their contact information so they can be called on to give a statement if necessary. You can also ask for copies of surveillance footage that might have captured the accident. If you cannot obtain this on your own, a lawyer can help.

Avoid giving statements: After the accident, you must avoid saying anything that could be used against you. For example, you don’t ever want to say things like “I’m fine” if someone asks if you’re okay. You also don’t want to admit that the slip and fall was your fault. Be polite, but try to avoid saying things that could be used to deny your claim, especially if you are being asked questions by the property or business owner’s insurance company.

Consult an attorney: The smartest thing to do after a slip and fall accident is to contact a lawyer. They will be able to guide you through the process, help you avoid saying anything that could be used against you, and help you gather evidence to build a strong case.

What to Do After a Slip and Fall Accident to Recover Compensation

Though property owners are legally responsible for maintaining a safe premise, this does not mean they can automatically be blamed for every accident on their property. For example, if you are shopping and someone spills a drink, and you immediately slipped and fell on the liquid before the owner could be notified, then you cannot reasonably expect that owner to be held liable.

Thus, to win a slip and fall case, you must be able to prove that the property owner knew about the hazard and failed to address it in a reasonable amount of time. And to do this, you will likely need to work with a lawyer.

When you file your claim, you will have to provide evidence that proves the following elements if you intend to recover compensation:

The property owner owed you a duty of care

A dangerous condition existed on the property

The property owner knew about or should have known about the dangerous condition

The property owner breached their duty of care by failing to address this dangerous condition in a reasonable amount of time

The dangerous condition was the direct cause of your slip and fall accident

You suffered damages (injuries) as a result of the accident

Proving the above elements is not easy. There are often arguments that come up, such as the owner trying to claim they didn’t know about the hazard. So you will need to work with a lawyer to gather evidence and build a strong argument that the property owner cannot refute.

How an Indiana Slip and Fall Attorney Can Help

If you or a loved one were injured on someone’s property, you have a right to file a claim against them to pursue compensation for your injury and other damages. Money awarded for damages can help cover medical expenses, loss of wages if you miss work, and pain and suffering. However, proving fault in a premises liability case can be difficult.

Did you know 1 in 5 falls will cause a serious injury like a broken bone or a head injury? Falling is the nation’s most common cause of traumatic brain injuries (TBIs) and falls cause 95% of all hip injuries in older adults.

After a frightening fall, it’s natural to look back at the situation and wonder what happened. Perhaps the property owner could have done something to prevent your fall and all the suffering resulting from it.

This article looks at falls from a legal standpoint. We’ll cover what the leading cause of slip, trip and falls is, the most common causes, and how to pursue a settlement that covers your damages from the fall.

What is a Slip and Fall Accident?

A slip and fall accident is a type of personal injury accident where someone falls to the ground or falls into an object due to slipping, tripping, stumbling, or falling over. While most of these accidents involve slipping on something like loose flooring, some falls arise from tripping over ground-level items like boxes and debris.

When you fall during an attack by an animal or person, it’s not usually classified as a slip and fall injury and would instead be considered a dog bite injury, a criminal assault, or something similar. If you’re unsure whether your injury qualifies as a slip and fall accident, speak to a personal injury lawyer who specializes in this aspect of the law.

What are the Common Causes of Slip and Falls?

The leading cause of slip, trip, and falls is the same here in Indiana as it is across the nation: unsafe floors. Loose and dangerous flooring materials create risky conditions and cause people to stumble as they walk.

Look closely at the area where you fell and determine what tripped you up. Was there a crumbling vinyl floor tile that caught your foot? Did you trip over a flap of old, ragged carpeting? Was the floor full of trash and clutter? Perhaps the property owner failed to repair a loose step, which caused a slip and fall on stairs.

Among the other top causes of slip and fall accidents are wet and icy surfaces like floors, sidewalks, and parking lots. Unsuspecting visitors attempt to walk across slippery areas and go tumbling to the ground as they slip.

According to the Centers for Disease Control (CDC), other common causes of slip, trip, and falls include stepladders, cluttered floors, loose and missing handrails, inadequate lighting, and unsafe surfaces. The CDC says many falls in retail stores are attributable to these causes, plus hazards from flooring, liquids, and ice.

Who’s Responsible for My Slip and Fall Costs?

In Indiana, all property owners have a duty to reasonably prevent injuries from occurring on their property. When they know about unsafe conditions and allow them to persist, they’re creating dangerous situations for visitors.

You can hold a negligent property owner responsible for your medical bills and other damages from the fall. You’ll need the help of an experienced Indiana slip and fall lawyer who knows how to build a strong case for maximum compensation.

Some property owners try to use Indiana’s open and obvious doctrine as a defense against liability for slip and fall accidents. They could claim that the area was obviously risky to any reasonable person, so they’re not at fault. However, the courts may not agree, especially if the landowner failed to maintain the property or display proper slip and fall caution signs.

What is the Average Slip and Fall Settlement Amount?

If you pursue a slip and fall settlement, it’s ideal to be awarded at least enough compensation to cover your medical bills, lost days of work, lawyer’s fees, and other costs directly attributable to the accident. Don’t forget about your pain and suffering, which may impact your life so severely that it adds considerable value to your case.

About 95% of all slip and fall accidents will result in settlements rather than going to trial. These settlements vary widely in amounts. A Forbes study found that half of all plaintiffs receive less than $24,000, but half receive considerably more.

When you browse personal injury lawyers’ websites, you’ll see that settlements of $50,000 to $100,000 are quite common.

A serious accident can change a person’s life. Car accidents, slip and falls, dog bites, and other accidents have the potential to leave victims with expensive and permanently disabling injuries. And these injuries are extremely painful both physically and emotionally. If you’ve suffered physically or emotionally after an accident caused by another party, you need to seek pain and suffering damages.

If you suffer from an accident that leaves you temporarily or permanently disabled, you may struggle with mental health challenges, such as depression and anxiety. Additionally, the wreck itself or your resulting medical treatments can result in you developing post-traumatic stress disorder (PTSD).

These different afflictions often require ongoing mental health treatment, such as therapy and medications, and they can ultimately impact your enjoyment of life. In this blog, you’ll learn about how to calculate your pain and suffering damages in Indiana.

What Are Non-Economic Damages in Indiana?

Before we discuss calculating pain and suffering damages, it’s important to know that pain and suffering is considered a non-economic damage. The two main types of damages in personal injury cases are economic and non-economic.

Economic damages are meant to reimburse you after an injury. You’ll likely face expensive medical bills, and your injuries can potentially prevent you from working temporarily or permanently. For that reason, victims can recover economic damages for past and future medical bills, lost wages, and loss of future earnings. Additionally, you can recover damages that reimburse you if the accident damaged your property, as is the case with car accidents.

Unlike economic damages, non-economic damages are not strictly calculable because they’re not intended to reimburse you. These damages are difficult to quantify because they do not have a direct financial cost. Instead, they’re intended to compensate for your pain and suffering. Of course, no amount of money can truly match what you’ve gone through, but these damages at least aim to help you on your path to healing as much as possible.

What Qualifies as Pain and Suffering?

Pain and suffering can include many different types of discomfort brought on by your accident. These are:

Physical Pain: Accidents often result in physically painful injuries and medical treatments, such as surgeries.

Emotional and/or Psychological Pain: Your accident and resulting injuries can cause emotional and psychological pain including PTSD, insomnia, fear, depression, and anxiety.

Loss of Enjoyment of Life: If you suffer from temporary or permanent disabilities or mental health issues, you may struggle to enjoy life. You may not be able to enjoy the same activities that you did before your injuries, such as sports, exercise, and hobbies.

Loss of Companionship: Loss of companionship is a form of pain and suffering awarded to a victim’s family member. For example, if a victim suffers fatal injuries or injuries leaving them with sexual dysfunction, their spouse may be able to recover loss of companionship damages.

Grief: If the victim dies during or after the accident, a family member, spouse, or partner may be able to recover pain and suffering damages.

How to Calculate Pain and Suffering

If you find a pain and suffering calculator online, it will most certainly be inaccurate. Every case is different, and the amount that you can recover will depend on a variety of circumstances that are outside of the scope of a simple Google search.

That said, different considerations can help you understand pain and suffering calculations, and you can consult with an experienced personal injury attorney to get an approximate estimation of how much you could expect.

If you’re wondering, “How is pain and suffering calculated,” the answer will depend on several factors. The factors that will likely determine how much you can recover are:

The evidence in your case

Whether you were partially at fault for the accident

The injury you suffered

The medication you’re now on due to your injuries

How the injuries impact your life

The amount of time it will take for you to recover

If you were partially responsible for your accident, you won’t be able to recover as much in compensation. Indiana uses a modified comparative negligence system, meaning that your percentage of blame directly impacts your compensation. For example, if you’re involved in a wreck and are found 10% at fault, your damages will be 10% less than what you would have recovered if you hadn’t been partially responsible.

Pain and Suffering Damages Calculated

How pain and suffering damages are calculated is through a multiplier method and a per diem method. With the multiplier method, your economic damages are multiplied by your degree of impairment. The court will assign an impairment rating between one and five, with “one” being mild and “five” being catastrophic. Let’s say that your economic damages are $20,000 and you receive an impairment rating of “three.” Your total damages will be $60,000.

The other method is per diem, Latin for “by the day.” With this method, your pain and suffering is assigned a specific dollar amount, and you receive that amount each day on which you’re recovering. For example, if your per diem amount is $70 and it takes you 300 days to recover, the total amount would be $210,000 (70 x 300).

Increase Your Pain and Suffering Damages By Hiring a Personal Injury Attorney

If you suffered from an accident caused by the negligence or deliberate wrongdoing of another party, you need to file a claim or lawsuit to recover damages for pain and suffering as well as medical bills, lost wages, and loss of future earnings.

Just about everyone has either fallen down the stairs or experienced a horrible second or two when they missed a step and thought they were going to fall downstairs. It truly is a frightening moment that your body reacts to before you can form a logical thought and realize what has happened. Even in the times when you didn’t fall, you probably felt that rush of fight-or-flight adrenaline and the panicked thumping of your heart for the next few minutes.

Unfortunately, for many people, slips and falls on the stairs are more than brief heart-in-throat moments; an average of 1,076,558 people each year are injured badly enough to have to be treated in emergency rooms after stair-related falls. Even worse, an average of 12,000 people die each year after falling on stairs.

Obviously, there are many reasons why you might incur a staircase injury. You may be distracted and not paying attention. You may lose balance on your shoes or trip over a pile of laundry that you meant to bring upstairs. You may feel dizzy, or your ankle may roll at an inopportune moment.

But what if you are not at your own home and you were injured as a result of someone else’s negligence? You do have the right to recovery through Indiana’s premises liability law.

Before we discuss liability, let’s look at some of the common reasons people slip and fall on stairs:

Loose carpets, rugs, or stair runners

Even one protruding corner or frayed segment of carpet can be catastrophic if you catch your foot and trip.

Loose or missing handrails

The lack of handrails is a building code violation. According to Indiana Code R311.7.8, “Handrails shall be provided on not less than one side of each flight of stairs with four or more risers.”

Spilled substances that make the stairs slippery

Ice or snow (or melted ice and snow) on outside steps

Highly polished or waxed floors that make it easy to slip

Incorrect dimensions for the rise or tread of the stairs themselves

We ascend and descend so many flights of stairs in our day-to-day lives that we don’t consciously have to think about how high to lift or lower our feet. Stairs that aren’t uniform are dangerous because our inner auto-pilot is thrown off when we encounter something out of the ordinary.

Indiana requires that the riser (the vertical part of the stair that goes up between the treads, or parts you step on) should be “not more than 81/4 inches (210 mm).”

Insufficient lighting

It’s easy to miss a step if you can’t see it.

Objects placed where they don’t belong or where they are easy to trip over

Who Is liable?

In Indiana, the property owner is responsible for your fall if certain conditions are met:

You were legally on the property. This includes places where you were invited (such as the house of a friend) or considered to be an invitee (such as a place of business).

The slip or fall occurred because of unsafe conditions. For example, if you simply lost your balance because you were talking, texting, or feeling ill, the state of the stairs didn’t cause your fall and injuries, but if you tripped over a loose board, the unsafe conditions did cause the accident.

You can begin by filing a claim with the relevant insurance company. Although it is awkward to feel as if you are demanding money from your friend after being injured at his house, it isn’t personal. You would be filing a third-party claim against your friend’s homeowner’s insurance company.

In a rented house or apartment, the claim would be against your friend’s rental insurance policy. If you fall in a common area of an apartment building, the claim would be against the insurance company of the property owner.

If you fall in a place of business, your claim would be filed with that company’s commercial property insurance company.

In some cases, that may be the end of it. You receive the appropriate compensation, and you are able to pay your medical bills as well as any other expenses resulting from the accident. Unfortunately, as you probably have already surmised, that doesn’t always happen. Insurance companies are in business to make a profit, and their goal is to pay the least amount possible. They may even attempt to claim that the accident was your fault.

This is where an experienced slip-and-fall liability attorney can work to make sure that you are adequately compensated. If you are not satisfied with the settlement that is offered, your attorney can file a lawsuit on your behalf.

Indiana premises liability law requires that in a lawsuit, you and your slip and fall attorney prove at least one of these is true:

The owner of the property caused the issue.

The owner of the property knew about the problem but didn’t take care of it.

The owner of the property should have reasonably known about the problem.

All landowners and property owners have a duty to reasonably prevent injuries on their property. Our team at Crossen Law Firm can work to help you gather the evidence needed to prove that a property owner failed in his or her duty of care and must compensate you for your losses.

If building codes were violated, you may be able to also hold the builder, designer, construction company, and/or architect liable.

Facts about injuries after a slip and fall on stairs accident:

The incidence of traumatic brain injury increases with the height (number of stairs) fallen.

According to the NIH, stair falls often cause spine, pelvic, or head injuries.

Other typical injuries include bone fractures, soft tissue injuries, neck injuries, and injuries to internal organs.

Those most likely to be injured in staircase accidents are elderly people and children.

More females (62.4%) are injured in these types of accidents than males.

Stairs are particularly dangerous for pregnant women (possibly because their center of gravity shifts). Over 39% of falls documented by pregnant women are stair-related.

Any type of injury is traumatic, and you need to be able to focus on your recovery. The personal injury lawyers at Crossen Law Firm will work diligently to recover fair compensation for your

Past and future medical expenses

Lost wages due to the inability to work

Mental anguish

Pain and suffering

You slipped and fell in a store, but the owner doesn’t want to take responsibility. They point to a warning sign posted nearby and claim, “It’s not my fault!”

Does this let them off the hook? The short answer is NO. It’s a myth that a property owner can simply post a sign and avoid all liability when people are injured on their premises.

Slip and fall cases are much more complex than just determining whether or not a sign is present. Here are some important things you should know about warning signs and Indiana premises liability.

Warning Signs Don’t Eliminate Liability

Property owners are required to maintain safe spaces that are reasonably free and clear of hazards. Under Indiana law, property owners must not allow dangerous conditions to persist if they’re aware of them.

Too often, property owners see potential dangers and try to avoid responsibility by doing nothing more than posting a warning sign. While warning signs are effective in many situations, they’re not always enough to prevent injury.

A bold, bright warning sign could still be too small to read, too far away, too poorly lit, or otherwise improper for a variety of other reasons. An employee may have moved the sign or obscured it.

Plus, displaying a warning sign alone might not be fully adequate in terms of legal liability. According to Indiana Law, property owners are responsible for keeping persons legally occupying their property safe. Outright dangerous conditions often call for much more than just posting a warning sign.

Did you encounter any of the following dangerous conditions?

Loose or broken flooring

Uneven tiles

Torn carpet

Floppy or unsecured floor mats/rugs

Cracked pavement

Broken stairways or handrails

Slippery floors

Holes or potholes

Cracks or crevices in the pavement/floor

Poor lighting

Missing or burned-out lights/bulbs

Small or out-of-the-way warning signs

A sign that was hard to read or understand

Talk to your personal injury lawyer about any signs or conditions that contributed to your slip and fall accident. An experienced lawyer will conduct a thorough investigation and reveal any evidence that could strengthen your case.

When the Sign Itself is a Hazard

You might be surprised to learn that a warning sign can also be considered inadequate if it’s permanently in place and too easy to overlook. When a sign is ever-present, people might ignore it or assume it’s out-of-date.

For example, McDonald’s has been sued for leaving “wet floor” signs out at all times, thus reducing the signs’ effectiveness in alerting restaurant patrons. McDonald’s has also been sued for using floor signs that are tripping hazards, creating dangers instead of preventing them.

As you can see, slip and fall cases can involve many factors. This is why personal injury lawyers and the courts are often involved in evaluating warning signs and related liability. You may have a strong case for injury compensation.

Who Will Be Held Liable for My Slip and Fall Costs?

There are many types of property owners who can be held liable for slip and fall injuries. You may be able to make a claim against:

A public/government agency

A private business, commercial landowner, or management company

A landlord

A homeowner or property owner

A homeowners’ association (HOA)

Your employer

Another involved party who contributed to your injury

In terms of covering your costs, make sure to evaluate all losses and damages you suffered as a result of your injury. Your total compensation for your slip and fall injury could include:

Loss of current and future income

Loss of your enjoyment of life

Pain and suffering

Emotional distress

Medical bills and copays, including hospital bills, prescription medication costs, physical therapy, medical equipment/supplies, and transportation costs

Starting a slip and fall case helps compensate you for the wide range of your losses. While no amount of money can ever ease the full burden of being injured, it comes as a huge relief to resolve your financial worries during such a stressful time.

When you set foot on someone’s property, you deserve to be in a safe place without fear of harm. Indiana property owners have a legal duty to keep areas safe for others.

Our state’s property owner liability law holds negligent owners responsible for others being injured on their premises, including inside buildings or on land they own. It’s unlawful to present an unreasonable risk of someone being hurt due to dangerous conditions.

If you’re hurt on someone’s property, you may be able to hold them responsible for your medical bills and other damages. However, a notable exception involves Indiana’s open and obvious doctrine.

What Is Indiana’s Open and Obvious Doctrine?

Property owners sometimes use the open and obvious doctrine as a defense against premises liability. If the area where the injury occurred has obviously risky and well-marked conditions, there’s a chance the property owner won’t be held liable.

For example, consider a processing facility with water sprayers cleansing goods. If large signs are posted throughout the premises that say “CAUTION: WET FLOORS,” it would be difficult to hold the property owner responsible for a slip-and-fall accident.

As its name implies, the open and obvious doctrine usually only applies when the conditions are clearly apparent. The courts also consider the surrounding conditions like handrails, flooring, lighting, safety features, and whether the dangerous conditions at the time of the injury were truly open and obvious to the average person.

How Will This Impact My Indiana Slip and Fall Case?

While a property owner isn’t required to provide a 100% guarantee of your safety on their property, they are expected to take reasonable care to maintain safe conditions. Your slip and fall injury could indicate that they failed to meet this standard of care.

To make your case, you’ll need to gather evidence that you were injured due to a foreseeable hazard that the property owner knew or should have known about. You’ll also need to show that your injury was directly due to an incident on their property and did not arise from some other cause.

It’s a good idea to look into whether the property owner has been visiting and inspecting their property regularly or has hired someone to do so on their behalf. Failure to inspect a property for dangerous conditions is an indication that the property owner neglected to meet the standard of reasonable care.

If you intend to bring a case against the property owner, don’t wait too long. Under Indiana Code section 34-11-2-4, you have just two years from the date of the incident. When the injured person is under age 18, mentally incapacitated, or dealing with a property owner who’s hiding their identity, there may be an extension of this deadline.

Your case could also be affected by Indiana’s status as a modified comparative fault state, also known as using the comparative contributory negligence rule. Injured people can only recover damages when they are less than 51% at fault. But the good news is that even if you are slightly at fault, you can still claim a lower amount of money that helps cover your costs.

From the property owner’s side, the cost of these claims is usually covered by having property owner liability insurance. Most of these cases never make it to court and are handled in out-of-court arrangements. If it does go to court, an owner who fails to have adequate insurance can be ordered to cover your costs personally.

The property owner may or may not choose to hire a property owner liability lawyer to represent them. Either way, it’s in your best interests to hire an experienced lawyer to protect your rights and explain your options for compensation.

What Types of Compensation Can I Receive?

Like other types of personal injury cases, slip and fall accidents can be life-altering. Victims of slip and fall injuries are eligible for both economic and non-economic damages. Your injury may prevent you from returning to work in a regular capacity, from being able to enjoy particular activities, and even from being able to care for yourself. Compensation in a slip and fall accident case can include:

Loss of current and future income

Loss of enjoyment of life

Pain and suffering

Emotional distress

Medical bills and copays such as:

Prescription medication costs

Physical therapy

Medical equipment

Transportation costs

Every penny counts when you are injured due to the negligence of a property owner. Money cannot return your life to the way it was before your accident, but it can help you find your new normal and adapt to a comfortable life again.
